Agreeing to these terms
These terms apply when you use the D&R O'Fallon Concrete Company website, starting at our home page, and when you ask us for a quote or hire us for a job. By using the site or booking work with us, you agree to them.
If you sign a written estimate or contract with us, that document controls your job. Where it says something different from this page, the written estimate or contract wins.
What we do
D&R O'Fallon Concrete Company is a concrete contractor in O'Fallon, MO, and we work in O'Fallon and the cities around it. Our work includes driveways, patios, sidewalks, steps, garage floors, stamped and decorative concrete, retaining walls, footings, foundations and related concrete work. We are licensed and insured.
The scope of your job is whatever your written estimate or contract describes. Work that isn't listed there isn't included unless we both agree to it in writing. You can read more about our crew on our about page.
Estimates and pricing
Quotes are free, we give them on site, and you're under no obligation to hire us. A quote is based on what we can see that day, including the size of the area, how much old concrete comes out, the condition of the ground the slab will sit on, access for the truck, and the finish you pick.
Some conditions only show up once the old slab is out or the digging starts, such as soft or wet soil, buried debris or roots. If that happens, we'll stop, show you what we found and tell you what it changes before we go on. Extra work and extra cost need your approval, in writing or by text or email, before we do them.
A quote is good for the period it states. After that, prices for material and labor may have changed, and we'll update it before scheduling.
Scheduling, weather and cancellation
We give you a start date when you book, and we'll tell you as soon as we know it has to move. Concrete depends on the weather, so we may reschedule a pour for rain, freezing temperatures or extreme heat, because pouring in those conditions can leave a weaker slab.
If you need to cancel or move your date, call us at (636) 614-2331 as early as you can. If your contract calls for a deposit, it will say whether any part is refundable and when. Once concrete is ordered or forms are set, those costs may not be recoverable.
Payment terms
Your written estimate or contract sets out what you owe, when it's due and how you can pay, including any deposit. Final payment is due when the work described there is finished, even if you're still waiting out the curing time before you use the slab.
If a payment is late, we may pause work until it's made. Where Missouri law allows, we may also charge reasonable collection costs on unpaid balances.
Your part of the job
We need clear access to the work area for our crew, equipment and the concrete truck. Please tell us before we start about anything buried that you know of, such as sprinkler lines, drain pipes or private wiring, because public utility markings don't show those.
Fresh concrete needs time to cure, which means hardening fully before it takes weight. We'll tell you when it's safe to walk on and when it's safe to drive on. Damage from using the slab early, or from people, pets or vehicles crossing the wet concrete, isn't something we're responsible for.
Warranties and what concrete does over time
Any warranty on your job is the one written in your estimate or contract. It covers the workmanship it describes, for the time it states.
Concrete can crack as it shrinks and as the ground moves with freezing, thawing and wet seasons. We cut control joints, which are grooves that give the slab a planned place to crack, but small hairline cracks can still appear and aren't a defect. Color and texture also vary a little from pour to pour, and new concrete won't match old concrete exactly.
Warranties don't cover damage from settling of soil we didn't prepare, poor drainage from roofs or yards we didn't build, deicing salts, heavy equipment beyond normal home use, tree roots, or work done by others after we leave. Beyond what's written in your contract, and to the extent Missouri law allows, we make no other warranties, express or implied.
Limits on our liability
To the extent the law allows, our total liability for any claim about a job is limited to the amount you paid us for that job. We aren't liable for indirect or consequential losses, such as lost use of a driveway, lost rent or damage caused by delays we couldn't control.
Nothing here limits liability that Missouri law doesn't allow us to limit.
Information on this website
What's on this site is general information about concrete work. It isn't a quote or advice for your property, because every yard, slab and soil is different. We work to keep the site accurate but can't promise every detail is current, and we may change it at any time.
If something goes wrong
If you're unhappy with any part of the work, call us first. Most problems get settled quickly once we come back out and look at them together.
If we can't settle it that way, we both agree to try mediation in good faith before either of us goes to court. Any lawsuit will be brought in a state or federal court located in Missouri.
Governing law
These terms, and any job we do for you, are governed by the laws of the State of Missouri, without regard to rules that would apply another state's law.
Changes to these terms
We may update these terms from time to time, and the version on this page is the current one. Changes don't affect a written estimate or contract you've already signed.
Questions about these terms
Call us at (636) 614-2331 or reach us through our contact page, and we'll answer any question about these terms before you book.
